Learn what you can do if you need to change the date of your small claims hearing.


Overview

If you need to change your small claims hearing date, do not send a letter to the judge or court. Instead, you should file a motion with the court to request that your hearing be continued to a future date. You should file your motion as soon as possible. Keep in mind that the court does not have to change your hearing date.

How do I change my court date if my small claims case is in the Las Vegas Justice Court?

If your case is filed in the Las Vegas Justice Court, you must prepare and file a Motion to Continue. The motion is also available, free of charge, at the Self-Help Center, or you can link to it by clicking underneath the form’s title below:

How do I change my court date if my case is in Henderson, North Las Vegas, or one of the other small claims courts?

If your small claims case was filed in one of the other justice courts in Clark County (Henderson or North Las Vegas, for example), you must file a Motion for Small Claims Continuance. The motion for those courts is available, free of charge, at the Civil Law Self-Help Center, or you can download the form on your computer by clicking one of the listed formats underneath the form's title below:

What happens after I file my request to change my court date?

When you file your motion to change the hearing date, check with the court clerk to verify how you and the other side will be notified if the court grants (or denies) your request to continue the hearing. You can monitor your case by checking its status on-line. Click to visit Look Up My Case.

If the court denies your request, you will need to do whatever is necessary to attend the hearing. Remember that if you fail to attend, the judge could dismiss your case or enter a money judgment against you.
